Terms of Service

1. Acceptance of Terms

Welcome to PageWeaver ("PageWeaver," "we," "us," or "our"). By accessing or using the PageWeaver platform available at pageweaver.ai (the "Service"), including all associated websites, applications, APIs, and services, you agree to be bound by these Terms of Service (these "Terms"). If you do not agree to all of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and PageWeaver. We may update these Terms from time to time as described in Section 16 below. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least eighteen (18) years of age to create an account and use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

PageWeaver is designed for use by parents, legal guardians, educators, and other authorized adults who wish to create personalized children's storybooks. The Service is not directed to children under the age of 13. We comply with the Children's Online Privacy Protection Act ("COPPA") and do not knowingly collect personal information directly from children under 13. If you are a parent or guardian and believe your child has provided us with personal information without your consent, please contact us at support@pageweaver.ai and we will take steps to remove such information.

If you are using the Service on behalf of an organization (such as a school, daycare, or corporation), you represent that you are authorized to bind that organization to these Terms, and "you" refers to both you individually and the organization.

3. Account Registration and Security

To use certain features of the Service, you must register for an account by providing accurate, current, and complete information. You agree to update your account information to keep it accurate and current.

You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately of any unauthorized use of your account. PageWeaver is not liable for any loss or damage arising from your failure to protect your account credentials.

You may not share your account with others, create multiple accounts for the purpose of circumventing limits or restrictions, or use another person's account without their permission. We reserve the right to suspend or terminate accounts that violate these provisions.

If your account includes Kids Mode functionality, you are responsible for setting and safeguarding the PIN code. Kids Mode provides a child-safe interface but does not replace parental supervision.

4. Description of Services

PageWeaver is an AI-powered platform that creates personalized children's storybooks. The Service includes, but is not limited to, the following features:

  • Character Creation: Upload photographs of children, family members, or friends, which are converted into multiple illustrated art styles using artificial intelligence.
  • Story Generation: AI-generated stories personalized with your characters, chosen themes, locations, and reading levels.
  • Image Generation: AI-generated illustrations for each story page, featuring your characters in the chosen art style.
  • Audio Narration: AI-generated audio narration of stories using text-to-speech technology.
  • Book Viewer: An interactive digital reader for viewing completed stories.
  • Export and Download: PDF and ePub exports of completed stories.
  • Print Ordering: Professional printing and shipping of physical books through our print fulfillment partner.
  • Gift Passes: The ability to purchase and send personalized storybooks as gifts.
  • Series Mode: Grouping related stories for sequential reading.
  • Sharing: Generating shareable links to stories and books.
  • Educator and Corporate Accounts: Specialized features for classroom and organizational use.

The Service utilizes multiple third-party AI providers to deliver its features, including but not limited to Anthropic, Google AI, OpenAI, ElevenLabs, and fal.ai. The specific providers and models used may change at our discretion to improve quality, performance, or cost efficiency.

5. User Content

"User Content" refers to any content you submit, upload, or provide to the Service, including but not limited to photographs, custom location names and descriptions, character names and descriptions, story preferences, and any other information you provide.

Ownership: You retain all ownership rights in your User Content. Nothing in these Terms transfers ownership of your User Content to PageWeaver.

License Grant: By submitting User Content to the Service, you grant PageWeaver a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, process, and display your User Content solely for the purpose of providing, operating, and improving the Service. This includes processing your photographs through AI models to generate style conversions and illustrations, and storing your content on our servers and those of our infrastructure providers.

Representations: You represent and warrant that: (a) you own or have all necessary rights to submit your User Content; (b) if your User Content includes photographs of minors, you are the parent or legal guardian of each child depicted, or you have obtained express consent from such parent or legal guardian; (c) your User Content does not violate any applicable law or these Terms; and (d) your User Content does not infringe the intellectual property or privacy rights of any third party.

No Training Use: We do not use your uploaded photographs or personal content to train our AI models or those of our third-party providers. Your photos are processed solely to generate the outputs you request.

6. AI-Generated Content

"Generated Content" refers to stories, illustrations, audio narrations, style conversions, and any other content produced by the Service's AI systems based on your inputs and preferences.

License to You: Subject to your compliance with these Terms and your active account or valid purchase (such as a Gift Pass), PageWeaver grants you a non-exclusive, non-transferable, revocable license to use, download, print, and share Generated Content for personal, non-commercial purposes. This license includes the right to order printed copies of your books through the Service.

Restrictions: You may not: (a) sell, sublicense, or commercially distribute Generated Content; (b) use Generated Content to train AI or machine learning models; (c) claim Generated Content as solely your own original creation in contexts where such a claim would be misleading; or (d) use Generated Content in any manner that violates applicable law or these Terms.

No Guarantees: AI-generated content is produced algorithmically and may contain errors, inconsistencies, or unexpected results. PageWeaver does not guarantee the accuracy, quality, or appropriateness of any Generated Content. While we employ content moderation and safety filters, we cannot guarantee that all Generated Content will be free from objectionable material.

Similarity: Due to the nature of AI generation, Generated Content produced for different users may be similar or substantially similar. PageWeaver does not guarantee the uniqueness of Generated Content.

7. Payment Terms

Certain features of the Service require payment. All payments are processed through Stripe, Inc. ("Stripe"). By making a purchase, you agree to Stripe's terms and conditions in addition to these Terms.

7.1 Subscriptions

Subscription plans provide ongoing access to Service features. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to subscription features until the end of your current billing period. No refunds or credits will be issued for partial billing periods.

7.2 Page Packs

Page packs are one-time purchases that provide a set number of story page credits. Page pack credits do not expire and are non-refundable once purchased. Credits are consumed when story pages are generated.

7.3 Gift Passes

Gift Passes allow you to purchase a personalized storybook for a recipient who may not have a PageWeaver account. Gift Passes are single-use purchases. Once a Gift Pass has been redeemed and the story generated, the Gift Pass is non-refundable. Unredeemed Gift Passes may be refunded within thirty (30) days of purchase by contacting support.

7.4 Pricing and Taxes

All prices are displayed in U.S. dollars unless otherwise indicated. Prices are subject to change with reasonable notice. Applicable taxes will be calculated and added at checkout based on your location. You are responsible for all applicable taxes associated with your purchases.

7.5 Refund Policy

Due to the nature of AI-generated content, refunds for generated stories are generally not available, as the computational resources have already been consumed. If you experience a technical failure that prevents delivery of your purchased content, please contact support@pageweaver.ai and we will work to resolve the issue or provide a credit at our discretion. Refund requests are evaluated on a case-by-case basis.

8. Print Orders

PageWeaver offers the ability to order professionally printed physical copies of your storybooks. Print fulfillment is provided by Lulu, a third-party printing and shipping partner ("Print Partner").

Fulfillment: Once you place a print order and payment is confirmed, your order is submitted to our Print Partner for production and shipping. Production times are typically five to seven (5-7) business days, plus shipping transit time.

Shipping: Print orders are currently available for delivery to addresses within the United States and Canada only. Shipping costs are calculated at checkout and vary based on the destination and shipping method selected.

Quality and Returns: If your printed book arrives damaged, defective, or with a significant printing error, please contact us within fourteen (14) days of delivery at support@pageweaver.ai with photos of the issue. We will arrange a replacement or refund at our discretion. Because each book is custom-printed, we do not accept returns for reasons other than damage, defects, or printing errors. Print quality is subject to the limitations of the printing process and may vary slightly from digital previews.

Print Partner Terms:Print orders are also subject to our Print Partner's terms and conditions. PageWeaver is not responsible for delays, errors, or issues caused by the Print Partner, shipping carriers, or customs processes, though we will make reasonable efforts to assist you in resolving such issues.

9. Acceptable Use and Prohibited Conduct

You agree to use the Service only for lawful purposes and in compliance with these Terms. You agree not to:

  • Upload photographs of individuals without the consent of the individual or, in the case of minors, without the consent of their parent or legal guardian.
  • Upload content that is sexually explicit, pornographic, or depicts nudity.
  • Upload content that depicts or promotes violence, abuse, self-harm, or cruelty toward children or any person.
  • Upload content that contains hate speech, discriminatory imagery, or symbols of hatred.
  • Use the Service to create content that harasses, bullies, threatens, or intimidates any person.
  • Use the Service to create content that is defamatory, fraudulent, or deceptive.
  • Attempt to bypass content moderation, safety filters, or other security measures.
  • Use automated means (bots, scrapers, crawlers) to access the Service without our prior written consent.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Create accounts under false identities or impersonate another person.
  • Use the Service to violate any applicable local, state, national, or international law or regulation.
  • Resell, redistribute, or commercially exploit any part of the Service without our prior written authorization.

Violation of this section may result in immediate suspension or termination of your account, removal of your content, and potential referral to law enforcement authorities where appropriate.

10. Content Moderation

PageWeaver employs automated and manual content moderation systems to ensure the safety and appropriateness of content on the platform. This includes automated checks on uploaded photographs, AI-generated stories and illustrations, and user-provided text inputs such as custom locations and character descriptions.

We reserve the right, but are not obligated, to review, screen, edit, or remove any User Content or Generated Content at our sole discretion and without prior notice. Reasons for content removal may include, but are not limited to: violations of these Terms, content flagged by our automated moderation systems, content reported by other users, or content that we determine to be inappropriate, harmful, or objectionable.

If your content is removed or your account is restricted due to a content moderation action, you may contact support@pageweaver.ai to request a review. We will evaluate your request in good faith but are not obligated to restore removed content or lift account restrictions.

11. Privacy

Your privacy is important to us. Our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using the Service, you acknowledge that you have read and understood our privacy practices.

By uploading photographs of children, you acknowledge and consent to the processing of those images by our AI systems and third-party AI providers solely for the purpose of generating the outputs you request. We implement technical and organizational measures to protect the security and confidentiality of all uploaded content.

12. Intellectual Property

The Service, including its design, software, code, user interface, logos, trademarks, and documentation, is owned by PageWeaver and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service itself, except for the limited right to use the Service in accordance with these Terms.

The PageWeaver name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of PageWeaver. You may not use these marks without our prior written permission.

Art styles, themes, predefined locations, and other creative frameworks provided within the Service are the intellectual property of PageWeaver. The AI-generated art style conversions and illustrations created using these frameworks are subject to the license terms described in Section 6.

13. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, PageWeaver disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, PageWeaver does not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the results obtained from the Service will be accurate, reliable, or satisfactory; (c) AI-generated content will meet your expectations or be free from errors or objectionable material; or (d) any errors in the Service will be corrected.

Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall PageWeaver, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Service, regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if PageWeaver has been advised of the possibility of such damages.

In no event shall PageWeaver's total aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the greater of: (a) the total amount you have paid to PageWeaver in the twelve (12) months preceding the event giving rise to the claim; or (b) one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, PageWeaver's liability shall be limited to the greatest extent permitted by law.

14. Termination

Termination by You: You may terminate your account at any time through your account settings or by contacting us at support@pageweaver.ai. Upon account deletion, your account enters a thirty (30) day grace period during which your data is retained and your account can be restored. After the grace period, your account and associated data, including uploaded photographs, characters, and generated content, will be permanently deleted.

Termination by PageWeaver: We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to: violation of these Terms, fraudulent or illegal activity, non-payment, extended inactivity, or conduct that we determine is harmful to other users or the Service.

Effect of Termination: Upon termination, your right to use the Service immediately ceases. Any outstanding payment obligations, and Sections 5, 6, 12, 13, 15, and this provision, shall survive termination. We are not obligated to retain or provide copies of your content after the deletion grace period has expired.

If your account is terminated for violation of these Terms, you may not create a new account without our prior written permission. Active subscriptions will be canceled, and no refund will be issued for the remaining subscription period in cases of termination for cause.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, conducted on an individual basis. You agree that any arbitration or legal proceedings shall be conducted on an individual basis and not as a class action, class arbitration, or other representative proceeding.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by posting the updated Terms on the Service and updating the "Last updated" date at the top of this page. For significant changes, we may also provide additional notice, such as an email notification or an in-app alert.

Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may terminate your account as described in Section 14.

17. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and PageWeaver regarding the Service and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Waiver: The failure of PageWeaver to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. PageWeaver may assign these Terms without restriction.

Force Majeure: PageWeaver shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, power failures, internet disruptions, or third-party service outages.
